These rules and restrictions are provided on behalf of the subdivision owners and the resident community at large.  Our purpose is to preserve and enhance property values, and to maintain a harmonious relationship among structures, natural vegetation, and topography within the subdivision.

1.    No improvements, alterations, repairs, change of paint colors, excavations, change in grade, or other work that alters the exterior of any property shall be made or done without the prior written approval of the College Park Estates Homeowners Association Architectural Review Committee (ARC). To request and obtain approval please contact Home Association Solutions at 913-825-0001.

2.    Owner(s) must restore homes totally or partially damaged or destroyed due to fire, wind or other damage at their own expense.  Restoration of the exterior must be completed in 6 months or less.

3.    Owner(s) must keep the exterior of their homes in good maintenance and repair. Owner(s) shall repair and replace as needed and maintain in good condition at all times. This applies to the exterior of the home and related improvements including, without limitation, foundation, roof, all patio enclosures, patios, decks, porches, sidewalks, driveway, concrete pads, air conditioning units, townhome exterior lighting, utility lines serving a unit, utility meter boxes, heat pumps, chimneys and flues, irrigation systems, plantings, trees, grass, and rain gutters.

4.    Owner(s) must keep fences and decks in good condition at all times.

5.    Owner(s) must decorate the exterior of their homes only in colors compatible with the area and acceptable to the owner of the attached home.

6.    Type and color of exterior material (siding, windows, trim, gutters, eaves, and roofing) must be consistent with the attached living unit.

7.    Owner(s) must keep and maintain in force on their home fire and extended (wind) coverage insurance at least in the amount of the home value, and shall name the College Park Estates II Homeowners Association a loss payee or additional named insured.

8.    Owner of each home is responsible for payment of Association Annual Assessment.  The Assessment is payable in 12 monthly installments to Home Association Solutions P.O. Box 26145 Overland Park, KS 66225. Monthly Homeowners Assessment is due on the 5th of each month and past due if not received by the 25th of each month. Failure of HOA to receive any monthly installment by the 25th day of the month or having a past due installment balance on the 25th day of any month will result in an additional monthly fee of $30.00 to be charged on the first day of the following month.  Collection efforts will be made on past due balances on behalf of the Association owners by the Board of Directors including the stop of trash collection filing of property Lien and other collection legal actions.  Owners are liable for the collection costs of past due balances.

9.    No commercial truck over 8,500 lbs., truck trailer, boat or motorcycle or motorbike or car/truck or house or camping trailer, motor home, airplane, or camping vehicle shall be parked overnight in the Plat other than in garages or basements, with the exception of regular parking of 2 vehicles in running condition, in a reasonable state of repair and preservation, with Gross Weight Vehicle Weight Rating (GVWR, calculated as weight plus carrying capacity) of 8,500 lbs. or less on any dwelling's driveway.  Additional non-commercial vehicles may be parked for up to 48 hours at a time in legal on street parking areas per applicable Overland Park city ordinances.

10.    Roof replacements with roofing system material change, siding system material change, or exterior color change, must be coordinated with the common wall home owner(s), and must be done as cost shared projects with the prior agreement of both common wall unit owners.

11.    Painting or siding of exterior must be coordinated with the common wall home owner, to ensure that both owners have input on the color and appearance outcome of the work.  Work may be done separately; in that case both homes must obtain the same appearance within 30 days.

12.    No outbuildings or detached structures may be erected without application to and approval of the Architectural Review Committee (ARC).

13.    Tanks for storage of fuel above ground are prohibited, with the sole exception of 20 lb. or less propane fuel tanks associated with residential outdoor grills, fire pits, or heaters.

14.    No animals may be raised, bred, or kept, other than two pets including dog, cat, or other household pets.

15.    No signs or advertising structures of any kind are allowed. The only exception being up to two signs totaling up to six square feet in size may be used to advertise the sale or lease of the home.  Note: Overland Park ordinances allowing signs expressing free speech related to elections, etc. take precedence over this rule.

16.    No automobile repair, rebuilding, or manufacture for hire or otherwise is allowed, except for repairs on a non-commercial, not for hire basis.

17.    Home owners are responsible for maintaining trees and shrubs in good appearance on their property other than the street side trees between the city easement between sidewalk and the city streets, which are maintained by Overland Park. The Homeowners Association will trim shrubs less than 6 feet high planted facing the street side or sides of homes unless the owner opts out of this service in writing.

18.    Owner(s) must opt out of lawn maintenance in writing, for all or a portion of their property. Owners are responsible for lawn maintenance for the portion of their property they opt out of, and must self- maintain the lawn to the overall standard of the remainder of the subdivision for any areas they perform their own lawn maintenance. Owners that opt out are still responsible for the total amount of dues.

19.    Owner(s) must perform their own lawn maintenance on any fenced portion of their property where access gates are not left unlocked for access, or where pets, loose or tethered, are left outdoors on mowing days. Owner(s) must provide a minimum 42 inch wide gate in order for the Homeowners Association to provide lawn care to fenced portions of property.

20.    Planting in areas the Homeowners Association provides lawn care must be identified with Edging, Mulch, or other border definition for protection from mowing and edging.
 
21.    Owner(s) may not place trash or recycling containers out curbside for collection earlier than 6 PM the day before collection. Containers should be returned from the curb within 24 hours of pickup. Trash that does not fit in the trash disposal container will not be picked up.  If you have additional trash, you may purchase overage stickers from Overland Park City Hall.
 
22.    Large trash items or piles of debris may not be left outdoors. Roll-off debris containers related to renovation, repair, or remodeling may be placed in driveways for a maximum of 30 days.

23.    Dog mess must be picked up, even within your own un-fenced property and in particular in areas outside of your property.
